Public Law Unit

Our Public Law Unit deals specifically with Constitutional and Administrative legal matters and extensively in a Municipal and parastatal environment. We have acquired vast experience with regard to Constitutional and Administrative law matters including:

1. Interpretation and application of the Municipal Structures Act, Municipal Systems Act, MFMA and similar local government legislation
2. Drafting legal opinions
3. Drafting or Review of By Laws
4. Drafting or Review of Policies
5. Preparation and negotiation of contracts
6. Management of bid disputes
7. Litigation, Arbitration and Mediation We act for local government and parastatals in a wide range of litigious matters. Instructions are handled within the cluster and in conjunction with litigation specialists.

Litigation has been conducted on behalf of local government in the following forums:

• Magistrates Court
• High Court
• Labour Court
• Supreme Court of Appeal
• Constitutional Court

8. General advice and assistance with regard to public administration and local government. Since the advent of the constitutional dispensation we have rendered ongoing legal advice and assistance to municipalities, parastatals and provincial government in the Eastern Cape Province. This has led to our acquisition of a considerable understanding of and insight into the objectives, activities and challenges with which public administration functions.
